Terms of service

These terms are an agreement between OveliTHub ("we", "us") and the company or person that signs up for Ovel EVV ("you", the "customer"). By creating an account or using the service you accept them. If you sign up for a company, you confirm you may bind that company.

The service

Ovel EVV is online software for scheduling work, verifying visits and shifts with GPS, keeping task lists and notes, collecting timesheet signatures, calculating pay, and preparing invoices, claim files and EVV data exports. It includes a company panel, a worker app and a client portal. We may improve and change features over time; we will not remove a core feature you pay for without notice.

Accounts

• Keep your login details private. Each person needs their own login; do not share accounts, and never let one worker clock in for another.
• You are responsible for the users you invite or approve, including workers and client portal users, and for what they do in your account.
• Tell us at once at hello@ovelithub.com if you think your account has been misused.

Plans and billing

• The free plan covers up to 5 active workers. Paid plans are charged per active worker per month, with a plan minimum, at the prices on our pricing page. An active worker is one with at least one clocked visit or shift in the billing month.
• Annual plans are charged for 10 months and cover 12.
• There are no setup fees and no per-visit fees. Taxes may apply.
• You can change plan or cancel at any time. Changes apply from the next billing period; we do not refund partial periods unless the law requires it.
• If a payment fails and is not fixed within 14 days of our notice, we may move the account to the free plan or pause it. We will not delete data for non-payment without further notice.
• We may change prices with at least 30 days' notice by email. The new price applies from your next billing period after the notice.

Your data

The data you and your users put into Ovel EVV is yours. You give us permission to store and process it only to provide, secure and support the service. You can export it at any time. Our privacy policy explains how we handle personal information.

You are responsible for having the right to collect and store the information you add, including telling your workers that their location is recorded at clock in and clock out and getting any consent your state's law requires.

Healthcare information

If you are a covered entity or business associate under US health privacy law and you will store protected health information, you must sign a business associate agreement with us first, and use a plan that supports it. Do not store protected health information on the free plan or in the public demo. Until a business associate agreement is in place, you must not upload protected health information.

Your responsibility for rules and settings

Ovel EVV calculates pay, overtime, units and billing amounts from the settings you choose: pay rates, overtime rules, rounding rules, payers, authorizations and service codes. Defaults are starting points, not legal advice. You are responsible for choosing settings that match the wage and hour laws, Medicaid and payer rules, and contracts that apply to you, and for reviewing payroll, invoices and claims before you pay or submit them.

EVV data exports and claim files are prepared in the formats described in the app. Unless your plan includes it and we have confirmed it for your state, Ovel EVV is not certified to submit data to a state EVV aggregator or a clearinghouse; you are responsible for submitting files and for meeting your state's EVV requirements.

Acceptable use

Do not use the service to break the law, to record false visits or hours, to track anyone without the notice or consent the law requires, to send spam, to upload malware, to try to get into accounts or data that are not yours, or to overload or reverse engineer the service. We may suspend an account that does any of these things, with notice where reasonable.

The public demo

The demo company is fictional and shared by everyone who signs in with the demo logins. It is reset every night. Do not enter real personal or health information in it.

Free tools and guides

The free tools and guides on this website give general information, run in your browser and are provided as they are. They are not legal, tax, payroll or billing advice. Check the results and any figures with your state Medicaid agency, payers, labor office or adviser before relying on them.

Availability and support

We work to keep the service available and to fix problems quickly, but we do not promise it will never be interrupted. We may do maintenance, ideally outside US business hours. Support is by email at hello@ovelithub.com.

Limits on our liability

To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, or denied claims, wage claims or penalties that result from settings you chose or records you did not review. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

Ending the agreement

You can close your account at any time from the app or by email. We may end the agreement with 30 days' notice, or at once for a serious breach of these terms. After closing, you have 30 days to export your data, after which we delete it as set out in the privacy policy.

Changes to these terms

We may update these terms. We will post the new version here and email customers about material changes at least 30 days before they apply. Continuing to use the service after that means you accept the new terms.
